Mahindra Roxas may face permanent ban in US | Tech US News


Mahindra has been selling the Roxor off-roader in the US for some time now, but has struggled with design infringement cases from Fiat Chrysler Automobiles in the past.

The Indian SUV maker may face a ban on the sale of the Mahindra Roxas in the North American market. Roxor is a 2 and 4 seater off-roading jeep that is quite popular among those looking for an affordable adventure. In June 2020, the United States International Trade Commission ruled that Roxor infringed on Jeep’s trade dress. Hence, Mahindra had to restrict imports and sales of Roxar.

Mahindra may face ban on Roxar sales.

As a result, Mahindra redesigned the Roxor to look significantly different from Jeep products. It was relaunched in the USA in November 2021. This time around the exterior styling has been substantially changed to avoid any kind of infringement. However, it is reported that the US Circuit Court of Appeals may review the case after the FCA appeals. Initially, the decision was that an average person would be able to distinguish between Jeep and non-Jeep products.

Also, the 6th Circuit held that Mahindra is a known infringer and should be held to a higher standard to ensure that Roxor’s design does not resemble Jeep products. That appeals court sent the case back to the Detroit court (where the original decision was taken) to reconsider whether the new Roxor’s design kept a ‘safe distance’ from Jeep’s design. The 2022 Mahindra Roxor is powered by a 2.5-liter m2DiCR turbo diesel engine that makes 62 hp and 144 lb-ft (195 Nm) of peak power and torque. It is mated to a 5-speed manual gearbox with a 2-speed manual transfer case with 2WD and 4WD drivetrains. Top speed is limited to 55 mph (88 km/h) as it is primarily a capable off-roader.
