HYDERABAD: The Telangana High Court on Tuesday ordered the National Medical Commission, Kaloji Narayan Rao University of Health Sciences and other petitioner students to allow the petitioner students to attend counseling for admission to MBBS and BDS courses.
A High Court bench comprising Justices Abhinand Kumar Shavili and N Rajeshwar Rao asked the two institutions to admit the petitioner students to MBBS and BDS courses if they belong to the merit zone.
The court ruled that the notification of October 10, 2022 cannot take away already accumulated rights from the student petitioners. Tekumala Vidita and three others filed a petition asking the court to order the respondents to allow them to participate in the MBBS/BDS admission process.
Counsel for the petitioners said that they are persons of Indian origin and children of non-resident Indians. They studied in Telangana for four consecutive years and appeared for the National Eligibility-cum-Entrance Test-2022 for admission to MBBS/BDS programs.
Counsel for the petitioners drew the court’s attention to GO 114, Department of Health, Medical and Family Welfare, issued on 5th July, 2017, detailing the Telangana Medical and Dental Colleges Admission Rules, 2017 and expressly states that Rule 3 describes the requirements for admission to MBBS and BDS programmes.
Standing counsel for Kaloji Medical University drew the court’s attention to the notification issued by the Union of India categorically stating that NRIs in respect of appearing in All India Entrance Tests like NEE, JEE Mains and Advanced or such other tests are entitled to he enters only at any NRI seat or any additional seat.
